Greenville Police Blotter – August 22, 2025

ASSAULT

August 9, 2025 – At approximately 8:36 pm, I was dispatched to 520 Martin Street. I made contact with Rocky Yoder reference an assault.

I spoke with Yoder, who stated he was biking home from work when he was struck by a blue Chevy Malibu being operated by Donald Wood. Yoder stated that he was biking near the intersection of Hall Street and Warren Street on the left side of the road when Wood crossed over from the right side of the road and struck him with the vehicle. Rocky stated that Donald struck him with the intent to harm him.

Yoder was checked by the squad and denied treatment. Yoder additionally stated that he was not injured.

Yoder stated he wanted charges and was given a witness statement form and a victim’s rights form to be filled out and returned to the Police Department.

Later on, PO Wentworth made contact with Yoder who stated he no longer wanted to be a victim.

DUI

August 14, 2025 – At approximately 9:21 pm, I observed a white Chevy bearing Ohio registration HVU9841 traveling north on North Main Street in the City of Greenville. I observed this Chevy to be traveling without any exterior lights activated. Sunset was at approximately 2035 hours.

I initiated a traffic stop on the vehicle on North Main Street near Spring Street. As I approached the vehicle, I could hear loud music and saw that the driver was looking around and appeared to be nervous. I then knocked on the passenger side window and made contact with the driver, Jared Duane Spahr, who is also the registered owner of the vehicle. I introduced myself to Jared and advised him that the reason for the stop was that his vehicle was not having any lights on. Jared then replied, “They’re not?” as he looked around the vehicle. Jared then apologized and stated, “I’m sorry I don’t know how they were off.” During this, Jared was slurring his words and was avoiding eye contact with me.

At this time, and due to Jared’s behavior, I requested Sgt. Marion to the scene.

I then asked for Jared’s ID and continued to ask him questions while he searched for it.

During this conversation, Jared continued to slur his speech and, when he made eye contact with me, I could see that his eyes were bloodshot and glassy. During this conversation, I began to smell the odor of alcoholic beverages coming from Jared’s breath as he faced me to talk. When Jared handed me his driver’s license, he advised me that the address on the card was not his current address. I then asked Jared for his new address and he was unable to properly provide me the new address. Throughout this interaction, Jared appeared to be confused due to suspected alcohol intoxication. I then asked Jared about any drugs being inside the vehicle, to which he stated that a K9 may alert to his vehicle due to traces of THC.

I then asked Jared for consent to search the vehicle, to which he replied, “You’ll find alcohol. I’ll admit you’ll find an open container.” I asked Jared if he had been drinking tonight, to which he replied yes. I subsequently asked Jared how much he had to drink tonight, to which he stated, “I drank a few beers and a couple shots.” Jared then continued slurring his speech and began stuttering. When I asked Jared about the open container, he pulled a cold open 24-oz Bud Light from the passenger side floorboard. I then walked back to the cruiser to speak with Sgt. Marion and advise him that I was going to ask Jared to perform SFSTs.

I then returned to Jared’s driver’s side of the vehicle and asked him to perform a complete series of Standardized Field Sobriety Tests, to which he agreed. The first test I had Jared perform was the Horizontal Gaze Nystagmus (HGN) test. I placed Jared into the starting position and gave him instructions, which he stated he understood. I observed 6 clues during this test. I observed distinct and sustained nystagmus at maximum deviation in both eyes, lack of smooth pursuit in both eyes and onset of nystagmus prior to 45 degrees in both of Jared’s eyes.

The next test I had Jared perform was the walk and turn. I gave him instructions, which he stated he understood. I then demonstrated this test for Jared. I observed 5 clues during this test. I observed Jared moving his feet to keep balance while in the starting position. He continued to stop while walking to regain his balance, he did not touch heel to toe, he stepped off the line multiple times and he lost balance while making his turn.

The final test I had Jared perform was the one-legged stand. I placed Jared into the starting position and gave him instructions, which he stated he understood.

I then began demonstrating this test for Jared, and he attempted to begin before being told to start. After placing Jared back into the starting position, I again demonstrated this test for Jared and advised him that he could begin. During this test, I observed 3 clues. I observed Jared swaying to keep his balance. He raised his arm more than 6 inches from his sides and put his foot down multiple times.

Due to Jared’s poor performance on the field sobriety testing, as well as indicators and his admissions prior to testing, Jared was placed under arrest and into handcuffs that were gap-checked and double-locked. Jared was read his Miranda warning upon arrest, which he stated he understood. Jared was searched incident to arrest with nothing located. Due to Jared having a large K9 in the backseat, he called his sister to come pick up the K9 and legally park his vehicle. Upon her arrival on scene, Jared gave consent to search his vehicle. During this search, 16 empty ‘Bud Light’ aluminum can bottles were located in the backseat.

Jared was transported to the Greenville Police Department, where he was read the BMV2255 in the presence of E.C.O. Kies. Jared voluntarily provided a breath sample. The results of this sample showed a breath alcohol concentration of 0.156 per 210 liters of his breath. Due to Jared’s test results, his Ohio license was seized and his driving privileges will be placed under an ALS suspension. Jared was then advised that his license was placed under suspension.

Jared was issued a citation for Lighted Lights Required Sunset-Sunrise and OVI. Jared was given his copy of the citation, the BMV2255 and his breath results. Jared was then released to his sister at the Greenville Police Department.

Cruiser 1941 was checked prior to and after transport with no contraband located.

HOMELESS SUBJECTS

August 13, 2025 – At approximately 1:27 am, I was in the area of Annie Oakley Park, in the city of Greenville and noticed several subjects sitting in the gazebo past park hours.

Upon approaching the subjects in the gazebo, I could see they had numerous piles of belongings stacked up behind the gazebo. When making contact with the subjects, now known to me as Lanny Spahr, Daniel Subler, Natalie Bergman, and Cody Thomas, they admitted to owning all the items sitting behind the gazebo. They were informed to pick up all items and to move them somewhere else or they would be cited for littering.

While waiting for the subjects to move their belongings, I observed several open containers and detected a strong odor of an alcoholic beverage. After questioning the subjects about the open containers, it was found that Lanny Spahr and Daniel Subler had numerous open containers at the gazebo and admitted to drinking while sitting in the gazebo. The subjects were advised of park hours, and Spahr and Subler were issued citations for open container. They were advised of their court date and time and given their copies of the citations.

August 16, 2025 – At approximately 4:55 pm, I observed Michael Falknor lying on the sidewalk near the corner of E Fifth Street and South Broadway. I also observed numerous items of trash on a city park bench approximately 10 feet in front of Mr. Falknor. The trash consisted of a pop bottle with numerous cigarette butts inside, a styrofoam box with trash inside, an empty carton of cigarettes, and a clear bag with cigarettes inside. Mr. Falknor confirmed the items belong to him.

I had prior knowledge that Mr. Falknor is currently homeless and he often spends his time in the area and on the bench. I have spoken with Mr. Falknor numerous times about leaving his trash in the area and he has been warned not to do so. I have also spoken with Mr. Falknor on numerous occasions about assisting him in finding permanent housing and to my knowledge, he has not followed up with the resources he has been provided. There was a documented warning by P.O. Borowske on July 16, 2025, for a similar littering violation by Mr. Falknor.

Mr. Falknor cleaned up his trash, then he was issued a misdemeanor citation for littering and then released. The city of Greenville is currently working with multiple external agencies to assist Mr. Falknor and others with finding permanent housing.

August 16, 2025 – At approximately 11:27 pm, I responded to the 200 block of East Water Street to Fort Greenville in reference to multiple subjects camping in the park after hours.

Upon my arrival, I located Lanny Spahr, Cody Thomas and Natalie Bergman. These subjects were advised earlier today by Chief Benge and the Greenville City Mayor, Jeff Whittaker, that they cannot be camping in the Greenville City Parks. These subjects, along with multiple others, have been recently homeless and have been camping at the gazebo of the Annie Oakley Park. These subjects have been leaving trash, specifically, empty beer cans, around this area. This enforcement comes after multiple complaints were made to the City of Greenville from local businesses and civilians.

During the conversation involving these subjects, Chief Benge and the Greenville City Mayor, Jeff Whittaker, Sgt. Marion and I were also present. These subjects were advised that they needed to find somewhere else to stay, including the large number of items each of them had with them. These subjects were also explicitly advised that they cannot possess open containers of any kind in public areas, with the exception of DORA in designated areas. These subjects were also explicitly advised that if they were later found to be in any violation of park hours and/or open container laws, they would be arrested on those charges.

Upon speaking with Lanny, Cody and Natalie, it became apparent that Lanny was intoxicated from alcohol. Lanny, upon being woken up, was slurring his words, was unable to walk straight and the odor of alcoholic beverages was coming from his breath.

Upon looking around their camping area, multiple 24-oz beer cans were located empty and scattered around the area. P.O. Daugherty and P.O. Conway located multiple of the same ‘Cobra’ and ‘Milwaukee’s Best’ cans thrown down the embankment right behind their camping area. These are the same cans that were scattered around the area. The cans that could be accessed were found to be cold to the touch and were recently used. Other trash and associated items were also found scattered in the area.

Upon Sgt. Marion’s arrival on the scene, I placed Lanny under arrest and into handcuffs that were gap-checked and double locked. Lanny was read his Miranda warning upon arrest, which he stated he understood. Lanny was searched incident to arrest with nothing located. Upon placing Lanny in the backseat of Cruiser 1941, P.O. Conway and P.O. Daugherty were advised by Cody and Natalie that most of the empty beer cans that were located belonged to Lanny. Natalie and Cody were again warned for park hours and advised to clean up their area before being sent on their way.

I then transported Lanny to the Darke County Jail, where he was released to jail staff.

Photos were taken of the beer cans and trash scattered in the area. These photos also included the items belonging to these subjects, as well as the trash directly located by where Lanny was sleeping with his property. Lanny was issued misdemeanor citations for littering, a misdemeanor of the third degree and open container, a minor misdemeanor. Lanny was then advised of his court date and time.

The backseat of cruiser 1941 was checked prior to and after transport with no contraband located.

TRESPASS

August 19, 2025 – At approximately 9:11 am, I was dispatched to assist Chief Benge at 411 South Broadway Street, in reference to a trespass/open container complaint.

I arrived and made contact with Daniel Subler, who was the subject of the call. Subler was speaking with Chief Benge, who had observed Subler consuming an alcoholic beverage, which was determined to be a 25-oz can of King Cobra Beer. Chief Benge advised that he observed Subler consuming the beverage on the 2nd story stairs and trespassing at 411 South Broadway Street. Subler admitted to the violation while speaking with him.

He also advised that he had 2 additional 25-oz cans of King Cobra, which he intended to consume. Subler appeared visibly intoxicated and Chief Benge observed him stumbling down the stairs. Subler’s eyes appeared glossy, and he had an odor of an alcoholic beverage on his person.

Chief Benge made contact with the property owner, Michael Jones, over the phone, who advised that no one was permitted to be at the above apartments. Jones then advised that he wanted charges pressed for criminal trespass. Divinity Salon, located at 413 South Broadway Street, provided video footage of Subler walking onto the property carrying a black bag. Please see attached video footage.

Subler was placed under arrest for criminal trespass and open container. I placed Subler in handcuffs that were gap-checked and double-locked. Subler was transported to the Darke County Jail and released over to jail staff. Subler was issued his copies of the citations, one for criminal trespass and one for open container. Subler was advised of his mandatory court date.

I checked the back seat of my cruiser before and after transport and no contraband was located. Jones later came to the Greenville Police Department, where he filled out a statement and a victim’s rights form.

WARRANT

August 18, 2025 – At approximately 10:56 pm, I observed a gray Nissan bearing Ohio registration KCR1408 traveling East on Martin St near State Route 571 E. I was able to observe that the vehicle had a headlight out.

I conducted a traffic stop on the vehicle and made contact with the driver, Franz Hardin Jr. I ran him through LEADS/ NCIC and it was discovered that he had an active warrant through GPD for failure to appear for an arraignment on an original charge of Agg. Menacing, bond $1,025.00. I had Franz exit the vehicle and I placed him under arrest and into handcuffs that were gap-checked and double-locked. Franz was placed into the back seat of my cruiser and transported to the Darke County Jail where he was released to jail staff.

The back seat of my cruiser was checked before and after transport. The vehicle was towed by Aces Towing.
