Special Counsel Added for Power Line Hearing

Darke County Commissioners

DARKE COUNTY – The Darke County Commissioners’ September 29, 2026 regular meeting started at 9:31 a. m. with Commissioners Aultman, Combs, and Flatter present. The Commissioners then approved the minutes from September 24th.

The Commissioners introduced and approved the examination and allowance of bills for September 29th. The General Fund total was $31,021.64; the Outside funds were $214,050.73, totaling $245,072.37.

The Board of D.D., Darke County Microfilm, and Juvenile/Probate all had appropriation transfers. Developmental Disabilities transferred $12,500.00 to pay off the AWECC facility transition agreement with ESC, D.C. Microfilm transferred $10,000.00 for machinery and equipment, and Juvenile/Probate transferred $2,000.00 for operating. All were approved.

A fund transfer for MRTC to cover 3rd quarter support for $87,500 was approved.

A fund advance and two fund advance backs for Darke County Grants were approved. The advance was to cover SME invoices for the Palestine Gas Station Project totaling $84,309.58, from the 2025 Brownfield Grant.  The fund advance backs were from the 2024 CDBG grant for $62,534.00 and the Ohio Lead Safe Grant for $62,534.00.

Darke County LEPC and Homeland Security and Emergency Management signed an agreement for $8,000.00 for storage, budget services, reporting, and to provide office space for LEPC. It was approved.

Engineering Services for new Windcone reconstruction at the Darke County Airport was approved. Design and Construction services for BF&S will cost $46,145.00. This is ODOT project #27-18.

Residential and Commercial Building permits for the Building Dept. were set. The fees will stay the same as they are now. The Building Dept. will open for service on Oct. 1st, 2026.

The Commissioners retained the Plank Law firm to represent them to the Ohio Power Siting Board concerning the power line project (OPSB case #26-0809-EL-BTX) Plank is a specialized firm that handles OPSB matters. The cost will be $350.00 an hour, or $225.00 an hour when a junior associate is working for the county, plus a $4,000.00 retainer.

A Certificate of Appointment for Social Services Worker 2, Tess McClure, will be effective Oct. 13, 2026, for JFS and was approved.

Two resignations were approved. Animal Shelter worker Kirk Detling’s resignation will be effective 9/25/2026, and Dale Musser, Facilities and Safety Manager, will be effective 2/1/2027. Both were thanked for their service.

Solid Waste Tire Day received 61.08 tons of tires for recycling.
